GOA and FPC Challenge ATF’s Authority, Argue Zero Tax Invalidates Federal Tracking of Suppressors, SBRs, and SBSs
In a bold move, major gun rights organizations, including Gun Owners of America (GOA) and Firearms Policy Coalition (FPC), have filed a lawsuit in Texas’ Northern District federal court to eliminate the National Firearms Act (NFA) registry for suppressors, short-barreled rifles (SBRs), and short-barreled shotguns (SBSs).
The suit follows Congress’ passage of the “One Big Beautiful Bill,” which repealed the $200 tax stamp on NFA items.
The groups argue that without the tax, the NFA’s legal basis, rooted in Congress’ taxing authority, as upheld in Soninsky v. United States (1937), is invalid, rendering the registry unconstitutional.GOA’s Eric Pratt stated, “With the tax gone, the NFA stands on air.”
The lawsuit seeks to end federal tracking of these items, calling it unjustified gun control. While the pro-Second Amendment court battle offers hope, appeals could reach the Supreme Court.
